A Name/ID Affidavit provides title companies with the information needed for them to differentiate between people with the same or similar names. The more common your name, the more likely you’ll get to experience this process!
A part of the title commitment process includes identifying recorded documents and confirming their relevancy to the transaction. The title company must confirm whether a recorded document that is found is in fact tied to any of the parties involved with the purchase, refinance and/or sale of the subject property. Such documents may include liens, court decrees, bankruptcy filings and judgments. Any of these will impact title to the property and would therefore need to be either resolved or insured around as an exception from title coverage under the title policy.
